Terms of use

These terms of use describe the terms of use of this web or mobile app (hereinafter referred to as "the app") provide by Cuebly B.V..

Applicability and changes

These terms of use apply to your use of the app. We have the right to change these terms of use unilaterally. You will be informed in a timely manner about changed terms via an update, a message from web or mobile app or an email.

We have the right at all times to modify the app, modify or delete data, restrict the use of the app, or deny access to the app in whole or in part, temporarily or permanently. We will inform you about this in a timely and appropriate manner.

Use of the app

You are responsible for the correct and careful use of the app. You must refrain from unauthorized or careless use of the app. In particular, you should:

  • truthfully fill in data;
  • act confidential with personal login codes and keep them secret from other persons;
  • do not use the app for acts and/or conducts that violate applicable laws or regulations, morals, public policy or third-party rights. Under no circumstances is it permitted to add data, documents or files to the app that have any illegal or offensive (including sexist, pornographic, racist or discriminatory) content or (otherwise) infringe the privacy of third parties;
  • not use the app in such a way as to prevent its (proper) operation, breach security or harm us, the app or third parties;
  • not spread viruses through the app, or disrupt devices or systems in other ways, from us or other users of the app;
  • respect our good name and reputation at all times and ensure that the use of the app does not in any way damage our rights and/or reputation;
  • follow all our instructions and regulations for using the app.

If you violate these terms of use, we have the right to take any measures we deem necessary, such as suspending or terminating access to the app or recover any of the damage or costs from you.

You may not grant third parties access to the app, make the app available to third parties, sell, rent, decompile, subject the app to reverse engineering or modify it without our prior consent. Nor should you remove or (let) bypass technical features that are intended to protect the app.

Intellectual property rights

All intellectual property rights and/or similar rights to the app, including the underlying software, texts, images, video and sound clips, rest solely and exclusively with us or with our licensors. Ownership of data that you enter or save in the app will remain your property.

We grant you a non-exclusive, non-sub-licensed and non-transferable license to use the app within the framework of the objectives we have set. It is not allowed to use the app for other purposes.

Liability

The app has been crested with the utmost care and attention. However, we cannot guarantee that the app will always be available or work without interruption, errors, viruses, malware or defects and that the information provided is complete, accurate or up-to-date. We have the right to temporarily or permanently discontinue the app (unannounced) without any rights to be granted.

We are not liable for any damage or injury resulting from the use of the app, unless the damage or injury is the result of intent or gross negligence on our part. We are never liable for indirect damage or consequential damages, such as lost revenue or income. You will exempt us from all possible claims from third parties as a result of using the app.

Privacy statement

Our privacy statement is part of these terms of use and applies to any privacy-sensitive information or personal data that you provide to us through the app. We consider your privacy of great importance and therefore exercise the utmost care in the handling and protection of personal data.

View, correct, or delete data

You have the right to view, correct or delete your data. Next to that you have the right to revoke any permission you gave for the processing of data, and the right to object to the processing of your personal data. You have the right to data portability if digital personal data are processed by us either with your permission or for the performance of an agreement we have concluded with you. This means that you can submit a request, asking us to send the digital personal data we have stored about you in a readable computer file to you or an organization indicated by you.

You can send requests to view, correct, delete or transfer your personal data, a revocation of your permission, or an objection to the processing of your personal data to info@cuebly.com.

To ensure that a request to view was filed by you, we ask you to attach a copy of your identity card to your request. Please make your passport photo, MRZ (machine readable zone, the lines with numbers at the bottom of the passport), passport number and citizen service number invisible. We ask you to do this in the context of your privacy. We will respond to requests as quickly as possible and within four weeks at the latest.

We would also like to point out that you have the possibility to lodge a complaint with the national supervising authority, the Autoriteit Persoonsgegevens.

Cookies

A cookie is a small text file that is stored on your computer, tablet or smartphone when you first visit a website. You can unsubscribe from cookies by adjusting the settings of your web browser in such a way that cookies are no longer stored. Next to that you can delete all previously stored information via the settings of your browser.

Applicable law

Exclusively Dutch law applies to these terms of use. Any disputes arising from or in connection with these terms of use will be exclusively brought before the competent court in The Netherlands.
